IMPORTANT NOTE: Any individual or company doing work on residential property that produces yard recyclables and receives a fee or money for such work, including but not limited to tree surgeons, nurseries, lawn care services, and landscaping contractors, must remove the yard recyclables from the property at their own expense. This provision does not permit, however, the aforementioned individuals or companies to hire a private collection service to remove the yard recyclables without first complying with the requirements of the town code. The town may declare the failure to remove the yard recyclables by such persons a public nuisance. If the town is required to remove the yard recyclables, the town may fine the property owner for this failure. For the first infraction, the town may issue a fine that includes the cost of removal plus an administrative fee, which administrative fee shall not exceed $200.00. For the second and any subsequent infractions, the town may issue a fine for each infraction that includes the cost of removal plus an administrative fee, which administrative fee shall not exceed $500.00. In addition, the town may prohibit any individual or company which has violated this provision from performing any work in town. (Ord. No. 421, § 2, 12-21-04)
